1. • 1.1 Every job will automatically incur a call out fee upon initial arrival and is exclusive of any labour.
   • 1.2. A call out fee is not automatically incurred upon initial arrival, where:
     • 1.2.1. Different jobs/job sites are included upon a single invoice
     • 1.2.2. Extra work is agreed upon to be commenced within a 10 day period, for the same customer
     • 1.2.3. A job has been quoted inclusive of a call out fee
     • 1.2.4. An emergency call out fee has been charged on a previous invoice and site has been returned to within 10 days.
   • 1.3. A call out Fee may be incurred for any on site quoting.
   • 1.4. Any job site beyond 45km travel distance from the registered business address of Simlec Electrical & Solar pty ltd. will incur a Call Out Fee multiplied by two (2x).
2. • 2.1. Labour will be charged as an hourly rate of accumulated minimum increments of 15 minutes (or 0.25 hours).
   • 2.2. Labour is considered “chargeable” in any case where:
     • 2.2.1. Any time is spent on site
     • 2.2.2. Time is spent repairing or constructing parts/equipment/appliances off site
     • 2.2.3. Time is spent sourcing (including transit) special order materials/parts/equipment.
   • 2.3. Labour rate may be subject to temporary increases due to special circumstances (e.g. high demand periods, abnormal trading hours, high difficulty/speciality work)
3. • Any services called-upon outside standard trading hours (7:00-16:00 working days) required immediately will be deemed an Emergency Call Out.
   • 3.1. Emergency call out and labour rates are to be three times (3x) standard call out and labour rates (as defined in terms 1 – 2)
   • 3.2. Emergency rates may be subject to further rate increase in special circumstances (e.g. high demand periods, public holiday)
   • 3.3. Emergency call out fee is incurred 10 minutes after the point of call out (NOT upon arrival), cancellation after 10 minute period will result in customer forfeiting the value of the emergency call out fee.
4. • 4.1. Whilst every effort will be taken to minimise any damage to customers’ premises, Simlec Electrical & Solar pty ltd take no responsibility for the following, which are not quoted for or assumed to be quoted for in our rates:
     • 4.1.1. Repair of wall chases left when instructed to move electrical points from existing positions to new positions.
     • 4.1.2. Repair/plastering chases, wall boxes or holes left when wires are chased through walls, floors or ceilings.
     • 4.1.3. Painting of areas worked on for electrical works
     • 4.1.4. Damage to any fixed appliances, fittings or any electrical equipment when required to find faults.
     • 4.1.5. Removing replaced appliances from site. Removal of old appliances, providing they fit into our vehicle, will be charged at $75 for tipping fees.
   • 4.2. These are specialised areas and not ones which we are experienced in or capable of doing within our charge rates or quoted prices.
   • 4.3. All disputes or additional dealings between the customer and any thrid party sub-contracted by Simlec Electrical & Solar pty ltd is between the customer and third party and shall be settled between the customer and the third party without the involvement of Simlec Electrical & Solar pty ltd.
   • 4.4. It shall not be assumed any services mentioned within term 4.1 as well as any other service not considered provided by Simlec Electrical & Solar pty ltd are provided or externally contracted within our pricing or quotes.
     • 4.4.1. Services not considered provided by Simlec Electrical & Solar pty ltd, including those mentioned in term 4.1 shall only be included or provided where specifically stated with a written agreement or quote.
5. • 5.1. Simlec Electrical & Solar pty ltd do not have a credit account, all invoices are strictly C.O.D. (cash on delivery)
   • 5.2. Acceptable forms of payment: Debit card, Visa/Mastercard, Cheque, Direct EFT, Cash
   • 5.3. In the event the customer fails to pay any issued invoice Simlec Electrical & Solar pty ltd shall:
     • 5.3.1. Reissue the invoice concerned with an additional 3% bookkeeping fee every fourteen (14) days overdue
     • 5.3.2. Receive payment from the customer concerned for all credit agents’ fees incurred by Simlec Electrical & Solar pty ltd in debt pursuit.
     • 5.3.3. Pursue and affect any other remedies, which may be available to Simlec Electrical & Solar pty ltd to recover the debt, and it is agreed that all debt collection costs and legal fees will be deemed recoverable from the customer.
     • 5.3.4. Lodge a caveat over the customer’s interest in any real property or assets which the customer may have any interest now or in the future in order to secure the customer’s obligations to effect payment of the concerned invoice(s).
   • 5.4. Invoices are inclusive of GST
6. • 6.1. Prices given informally or formally are considered estimates only unless definitely stated as a quote with quote reference number.
   • 6.2. All quoted prices only apply to goods and services stated and included within the quote itself, any excluded or additional works or goods will be considered extra work excluded from the quote,
   • and therefore will incur extra cost
   • 6.3. It shall be assumed to be accepted by both customer and contractor that all completed works relating to but excluded or not mentioned in any concerned quote are approved and therefore shall
   • incur extra cost subject to rates included in these terms, and shall be payable further to the quoted amount.
7. If a ’7 Day Discount’ is applied, 3% of the full invoice shall be discounted for seven (7) days from the invoice date. Where full payment or evidence of full payment is not received on or before the 7th day the discount shall expire and the original full amount reinstated.
